Man Convicted Of Murder Denied Retrial Despite Twin Brother's Confession

An Illinois man who has been behind bars since 2003 for shooting a rival gang member was denied a retrial, despite the fact that his twin brother admitted to committing the crime. Kevin Dugar was sentenced to 54 years in jail after he was convicted of killing one man and wounding another in a shooting in Chicago. However, in September 2016, Dugar's twin brother, Karl Smith, shocked authorities when he claimed that it was him and not his brother who opened fire on the group of three people. 

Prosecutors were skeptical of Smith's confession and pointed out the twin brothers have a history of pretending to be each other in order to confuse people. They also argued that Smith only made the confession after he lost his own appeal and realized that he would likely spend the rest of his life behind bars for an armed robbery in 2008, in which a six-year-old boy was shot in the head.

"Did he have anything to lose? No," the judge said. "I find (Smith's) testimony completely uncredible. No weight whatsoever should be given to his testimony."
